• To track moods and provide personalized insights and features.
• To send account notifications, contest updates, and support communications.
• To send marketing communications about Mood Ticker and related future products or services (with your consent).
• To ensure app security and prevent fraud or abuse.

3. Data Sharing

• We do not sell or share user data with third parties.
• Payments are processed by Stripe; Mood Ticker does not store credit card or payment data.

4. Data Storage & Security

• Data is encrypted in transit and at rest.
• Accounts and all related data are permanently deleted immediately upon user request, except as specified in our Data Retention section regarding marketing email suppression lists.
• Account deletion is immediate and irreversible.

5. User Rights

• Account deletion is available by scrolling to the bottom of the app home page and clicking 'delete account.'
• Users may toggle email preferences on or off in Settings.
• Users may opt out of marketing communications at any time via unsubscribe links in emails or by emailing [email protected].
• We maintain a marketing suppression list to ensure you do not receive marketing emails after opting out; entries are retained for this purpose and are not deleted unless you re-subscribe.
• Users may request immediate deletion of all personal data through the in-app deletion process, subject to the marketing suppression list policy described in our Data Retention section.
• EU/EEA users have additional rights under GDPR including access, rectification, erasure, portability, and objection to processing.

6. Children's Privacy

• We do not knowingly collect data from children under 13.
• Users aged 13-16 require parental consent.
• If we learn that we have collected information from a child under 13, we will delete it immediately.

7. Lawful Basis for Processing (EU Users -- GDPR)

• For EU users, our lawful basis for processing includes:
• - Consent: Sign-up, email opt-in, marketing communications.
• - Performance of contract: Providing app services, account management.
• - Legitimate interests: Improving app functionality, maintaining suppression lists to honor opt-out requests.
• You may withdraw consent at any time by emailing [email protected] or using unsubscribe links in our emails.

8. Data Retention

• We retain data while your account is active.
• Locked Accounts: When a gift subscription expires without renewal, the account is locked immediately. All user data (moods, friends, contest history) is preserved for 14 days as a grace period. If the user pays within 14 days, the account unlocks and all features restore. If no payment within 14 days, the account and all associated data are permanently deleted.
• When you delete your account, all data is immediately and permanently removed, except as specified below regarding retention solely in a marketing suppression list to honor opt-out preferences.
• Marketing Suppression List: After account deletion, we may retain your email address solely in a suppression list (potentially in hashed form) to honor your opt-out preferences and prevent future marketing communications.
• Post-Deletion Marketing: We will not send marketing communications after account deletion unless you have separately opted in to marketing communications and have not withdrawn consent.
• Suppression-listed emails are used solely for preventing unwanted marketing and are not used for any other purpose.
• You may opt out of marketing communications by emailing [email protected] or using unsubscribe links, but suppression entries are maintained to honor these opt-out requests.
• Monthly Linkup Contest Data: Contest participation data, including linkup records, contest standings, and winner information, is retained for one (1) year for record-keeping and verification purposes. Data older than one year plus one day is automatically deleted from our systems.

9. International Users & Data Transfers

• Mood Ticker is based in the United States.
• By using the app from outside the U.S., you consent to the transfer of your information to the U.S., which may have different data protection laws.

11. Data Breach Notification

• In the event of a data breach that may compromise your personal information, we will notify affected users within 72 hours of discovering the breach via email and/or in-app notification.
• We will provide details about what information was involved, steps we are taking to address the breach, and recommended actions for users to protect themselves.
• We will also notify relevant authorities as required by applicable law.

12. Cookies and Tracking Technologies

• Mood Ticker may use cookies and similar tracking technologies to enhance user experience and improve our services.
• You may disable certain tracking through your device settings, though this may limit some app functionality.
• This tracking policy is enforceable to the fullest extent permitted by applicable law. Where local laws provide greater user rights regarding tracking and cookies, those laws shall supersede this policy.

13. Severability

• If any provision of this Privacy Policy is held invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
